1. Introduction
This End User Licence Agreement, or EULA, is a legal agreement between you and Justin Scott Bowen for your use of Wayfell, including the game software, updates, downloadable content, related content, documentation, and any associated services.
By installing, downloading, accessing, or playing Wayfell, you agree to this EULA. If you do not agree, do not install, access, or play the game.
If you access Wayfell through a third-party platform such as Steam, Epic Games Store, your use of that platform is also subject to that platform’s own terms and policies. This EULA applies in addition to those terms, and does not replace them.
2. Licence grant
Subject to this EULA and any applicable platform terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play Wayfell for your personal, non-commercial entertainment use.
You do not own Wayfell or any part of it. You are licensing the right to use it under this EULA.
3. Ownership
Wayfell, including its title, code, gameplay systems, artwork, characters, creatures, world, story, lore, music, sound effects, user interface, designs, logos, names, text, and all related intellectual property, is owned by Justin Scott Bowen or our licensors.
All rights not expressly granted to you are reserved.
4. Restrictions
You must not:
Copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit Wayfell except as allowed by this EULA.
Reverse engineer, decompile, disassemble, modify, or create derivative works from Wayfell, except where permitted by law.
Remove, alter, or obscure copyright, trademark, or proprietary notices.
Use cheats, bots, automation, exploits, unauthorised mods, or other tools that interfere with the game or platform services.
Circumvent access controls, DRM, platform restrictions, or security features.
Use Wayfell to infringe the rights of others or violate applicable law.
Upload or distribute malicious code, harmful content, or unlawful material through any related service.

5. Updates and changes
We may provide patches, updates, fixes, balance changes, content changes, or other modifications to Wayfell. Some updates may be required to continue playing the game or using certain features.
We may change, suspend, or discontinue parts of the game or related services where reasonably necessary, including for technical, security, legal, platform, or development reasons.
6. Saves, settings, and user data
Wayfell may create local or cloud-based save files, settings, logs, crash reports, or related data. Save data may become unavailable, corrupted, or incompatible due to updates, hardware issues, platform issues, user actions, or other causes.
We are not responsible for lost, corrupted, or unavailable save data except where required by law.
7. User content and feedback
If you send us feedback, bug reports, suggestions, ideas, gameplay clips, screenshots, comments, or other content relating to Wayfell, you grant us a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, display, distribute, and otherwise exploit that content for development, marketing, community, support, and business purposes.
You confirm that you have the rights needed to provide that content and that it does not infringe the rights of others.
You remain responsible for any content you submit or share.
8. Streaming, screenshots, and videos
You may create, stream, upload, and monetise videos, livestreams, screenshots, reviews, guides, commentary, and other community content featuring Wayfell, provided that:
The content is not unlawful, misleading, hateful, abusive, or harmful.
You do not imply that your content is official or endorsed by us unless we have agreed in writing.
You do not extract or redistribute game assets as standalone files.
You follow the rules of the platform where you publish the content.
We reserve the right to object to uses that are unlawful, harmful, misleading, or damaging to Wayfell, our community, or our rights.
9. Mods and fan content
Unless we provide official modding tools or written permission, you may not modify, redistribute, or create derivative versions of Wayfell.
Fan art, fan videos, screenshots, streams, reviews, commentary, and similar non-commercial community content are generally permitted under Section 8, provided they follow this EULA and do not misuse our intellectual property.
10. Third-party software and assets
Wayfell may include third-party software, middleware, plugins, fonts, engine components, store platform components, or other licensed materials. These components may be subject to their own licences or terms.
You must comply with any applicable third-party terms.
11. Online features
Wayfell may include or later add features such as achievements, cloud saves, leaderboards, analytics, crash reporting, playtests, community features, or other online functionality.
Online features may require an internet connection and may be unavailable, interrupted, changed, or discontinued. We are not responsible for interruptions caused by platforms, networks, third-party providers, maintenance, or events outside our reasonable control.
12. Termination
This EULA begins when you install, download, access, or play Wayfell and continues until terminated.
Your rights under this EULA will terminate automatically if you breach the EULA. On termination, you must stop using Wayfell and uninstall or delete any copies in your possession, subject to any platform rules about removal and access.
Sections relating to ownership, restrictions, feedback, disclaimers, liability, indemnity, governing law, and dispute resolution will continue after termination.
13. Disclaimer
To the maximum extent permitted by law, Wayfell is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise.
We do not guarantee that Wayfell will be uninterrupted, error-free, compatible with all hardware or software, secure, or free from bugs, crashes, or data loss.
Nothing in this EULA excludes, restricts, or modifies any consumer guarantees, rights, or remedies that cannot be excluded under applicable law.
14. Limitation of liability
To the maximum extent permitted by law, [Your legal name / studio name] will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses arising from or relating to Wayfell or this EULA.
To the maximum extent permitted by law, our total liability for any claim relating to Wayfell or this EULA will not exceed the amount you paid for Wayfell in the twelve months before the claim arose.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
15. Indemnity
You agree to indemnify and hold harmless [Your legal name / studio name], our contractors, licensors, service providers, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from your breach of this EULA, misuse of Wayfell, violation of law, or infringement of third-party rights.
16. Governing law
This EULA is governed by the laws of Queensland, Australia, unless another jurisdiction is required by applicable consumer law.
You and Justin Scott Bowen agree to submit to the courts of Queensland, Australia, subject to any rights you may have under mandatory consumer protection laws in your country or region.
17. Changes to this EULA
We may update this EULA from time to time. If we make material changes, we will take reasonable steps to notify users, such as by updating the date above, posting a notice on our website, or providing notice through the relevant platform.
Your continued use of Wayfell after changes take effect means you accept the updated EULA.
